Tax Rates
Spanish capital gains rates (base del ahorro)
Crypto gains in Spain are classified as ganancias y pérdidas patrimoniales and taxed within the base imponible del ahorro — the same bracket as other investment income. There is no long-term holding period exemption (unlike Germany).
Rates applicable for tax year 2024. Losses can be offset against gains; remaining losses carried forward up to 4 years.

FAQ
Common questions about crypto tax in Spain
¿Tengo que declarar crypto si no he vendido nada?
No si no has vendido ni intercambiado criptomonedas. Sin embargo, si tienes más de €50.000 en exchanges extranjeros a 31 de diciembre, debes presentar el Modelo 721 antes del 31 de marzo.
Do crypto-to-crypto trades count as taxable in Spain?
Yes. The Agencia Tributaria (AEAT) treats every crypto-to-crypto exchange as a disposal event. You must calculate and report the gain or loss in euros at the time of the trade.
Can I deduct losses from previous years?
Yes. Capital losses can be offset against gains in the same tax year, and any remaining losses can be carried forward for up to four years.
How does FIFO apply in Spain?
Spain requires the FIFO (First In, First Out) method for calculating cost basis on crypto assets. Taxxy applies FIFO automatically and generates the correct figures for your Modelo 100.
What is the Modelo 721 threshold?
If you hold crypto on exchanges or wallets outside Spain with a total value exceeding €50,000 at 31 December, you must file Modelo 721 by 31 March of the following year. There is no tax to pay — it is an informational declaration only.
Is staking income taxable in Spain?
Yes. Staking rewards are generally treated as "rendimientos del capital mobiliario" (capital income) and taxed at the same savings rates (19–28%). They are reported in Modelo 100.
